Gavin McKenna’s arrest story just changed, and some graphic details were just released by investigators.
Investigators in State College tied the case to an alleged January 31 incident downtown.
McKenna, 18 and a projected 2026 NHL Draft headliner, became a national name overnight for the wrong reason.
The initial charging stack included felony aggravated assault, plus a misdemeanor count and two summary offenses.
According to the affidavit language cited in reporting, the patient “could hardly speak” when officers met him at the hospital.
"The patient was in substantial pain and could hardly speak," the affidavit says. "The patient had two friends in the room with him who were both witnesses to the assault."
Witness accounts in the complaint alleged a brief exchange of words before punches were thrown.
"The friends recognized McKenna due to the fact he is on the Penn State men's hockey team," the affidavit says. "The friends could not remember exactly what McKenna was wearing at the time of the assault, but knew he had on a backwards hat."
Police also described video and street-camera angles that they say show key moments around the incident.
Then Friday brought the twist that changes the temperature.
CBS Sports reported the Centre County District Attorney’s Office dropped the felony charge after reviewing video evidence and re-checking the injury details.
The same report says McKenna still faces a misdemeanor simple assault charge and the summary offenses.
Latest details on Gavin McKenna's assault charge
Fans are split right down the middle here, because it’s hard to separate “future star” hype from the seriousness of a real legal process.
The DA statement quoted by CBS argues the video did not support the intent standard needed for aggravated assault.
If McKenna stays on the ice, his 2026 draft stock will still be debated, but now it comes with a headline nobody wants attached.
The next step is on February 11, when the remaining charges are scheduled for a preliminary hearing.
Do you think Gavin McKenna will still get drafted 1st overall in the 2026 NHL Draft?
